Sales Tax Recovery:
As a result of litigation pursued by Forrest, LaMothe, Mazow, McCullough, Yasi & Yasi, P.C., on behalf of a Massachusetts consumer, a nation-wide retailer recently agreed to provide refunds of erroneously collected sales taxes to thousands of Massachusetts consumers.
Medical Record Overcharge Recoveries:
The attorneys of Forrest, LaMothe, Mazow, McCullough, Yasi, & Yasi, P.C. have successfully recovered amounts allegedly overcharged by certain Massachusetts medical providers (and their medical record production agents) on behalf of numerous Massachusetts patients.
As a result of these successful claims, many of the larger medical record production companies operating in Massachusetts, as well as several medical providers, have altered their medical record request production practices, and either remitted the amounts overcharged to the patients or remitted overcharged amounts to health services related non-profit organizations.
Post Arbitration Award Interest Recovery:
The attorneys of Forrest, LaMothe, Mazow, McCullough, Yasi, & Yasi, P.C. have settled a state-wide Massachusetts class action claim on behalf of all persons who obtained arbitration awards against a nation-wide automobile insurer (or the insurer’s insureds). The named class representative alleged that the insurer wrongfully failed to pay post-award interest on said arbitration awards as required by Massachusetts law.
As a result of the class-wide settlement agreement, all members of the class were paid the full amount of interest allegedly withheld by the insurer with accruing interest thereon.
Unlawful Subpoena Charge Recovery:
Forrest, LaMothe, Mazow, McCullough, Yasi, & Yasi, P.C. has settled a state-wide Massachusetts class action claim on behalf of individuals and/or business entities who were sent invoices, and/or paid invoices, sent from a national insurance company (or its document production agent) wherein the insurer sought to collect purported charges to produce documents requested via a subpoena issued pursuant to the Massachusetts Rules of Civil Procedure.
As a result of the class-wide settlement agreement, all members of the class were paid the full amount of collected by the insurer (or its agent). Further, the defendant insurer issued a one-time payment to a designated cy pres organization in consideration of those persons who simply received the alleged unlawful invoices.
